  • Disable, damage, or otherwise interfere with security-related features of the application.
  • Modify, decompile, disassemble, or reverse engineer the application.
  • Copy, rent, lease, loan, resell, sublicense, distribute, or transfer components of our application to any third party.

You agree to follow all applicable local, state, national, international, and other rules, laws, and regulations - in particular, those regarding acceptable online conduct.

Content

Hematool® is an application for commonly available electronic devices (smartphone, tablet, and desktop computer) in the field of hematology. As an educational tool, it will include comprehensive material on hematological diseases, diagnostics, and therapies for reference. Besides content, our focus is on format and interface to offer a quick, simple, and structured application, avoiding sluggishness. It can function as a bedside tool, which can be used in daily practice for rapid decision making not only for hematologists, but also for internal medicine and other specialists. Hematool® should not be regarded by recipients as a substitute for a consultation with a specialist.

Use of content

The information and materials contained in Hematool® are provided «as is» and «as available». No representation or warranty, either expressed or implied, is provided in relation to the accuracy, completeness, truthfulness, or reliability of the application.
Hematool® or any of the publishers, editors, or authors make no representations or warranties of any kind, either express or implied, with respect to the information and functionality contained in Hematool®, including but not limited to warranties of title, non-infringement, merchantability, or fitness for a particular purpose. Without limiting the foregoing, Hematool® or any of the publishers, editors, or authors do not warrant the accuracy, timeliness, completeness, reliability, or availability of the application or the information or results obtained from use of the application, or that the application is virus-free or error-free.

Your personal profile

Personal profiles are meant to be used by individuals, not organizations. When registering a personal profile, you agree to provide correct and accurate information. You also agree to give us permission to store your credentials. You may only use your personal profile and not someone else’s personal profile without their permission to do so.

Violation of these Terms and Conditions may result in user information tracking. Offending users may be permanently restricted from using the application. If Hematool® reasonably determines that your personal profile is being used for illegal or fraudulent activities or activities not conforming to these Terms and Conditions, your personal profile will be immediately terminated and your data erased. We may also report you to law enforcement officials in the appropriate jurisdiction.

Personal profile security

You are solely responsible for safeguarding passwords that you use to access the application and you are responsible for any activities made with your personal profile. We encourage you to use strong passwords that are at least eight characters long, do not contain usernames or complete words, and contain a combination of upper and lower case letters as well as numbers and symbols. Hematool® will not be liable for any loss or damage resulting from unauthorized use of your personal profile or from your failure to comply with these Terms and Conditions. You are responsible to immediately notify Hematool® upon becoming aware of any security breach or unauthorized use of your personal profile.

Devices

To use our application, you need to have devices that are compatible with it. We do not warrant that Hematool® is compatible with your device.
You agree that we may, from time to time, upgrade or change our application and may automatically make changes to the application. Hematool® originates in Switzerland and is subject to national laws and regulations. You agree to comply with all Swiss and foreign laws related to the use of Hematool®.

Branding

Hematool® is a trademark registered by the Swiss Federal Institute of Intellectual Property. If you use the trademark «Hematool» (including our logo), you need our written approval in advance.
Do not use the trademark «Hematool» (including our logo) or a confusingly similar trademark and/or logo in a way that falsely implies a relationship or affiliation with, sponsorship, or endorsement by us. Your own name and logo must be more prominent than the Hematool® trademark and/or logo.
You can link to our application, but if you do so, you have to make sure that the link is legal and does not damage our reputation or take advantage of it. You must not establish a link to our application on any website that is not owned by you. Otherwise, we will request you to remove the link to our application.

Third-party Services

Our application might have links or hints to third-party services, such as websites, files, or documents. Hematool® does not assume any responsibility for third-party services. If you access a third-party service through our application, you are responsible for any consequence and do this at your own risk. You understand that our Terms and Conditions and Privacy Policy do not apply to third-party services. You expressly relieve Hematool® from all liability arising from accessing third- party services.

Property and User Feedback

All right, title, and interest in and to the application are the exclusive property of Hematool®. Any comments, questions, ideas, feedback, suggestions for improvements (collectively called «Feedback») are entirely voluntary and are not confidential. You hereby grant us a worldwide, perpetual, irrevocable, royalty-free license to use such Feedback as we deem appropriate for all commercial or not commercial purposes, at our sole discretion.

Termination

Hematool® can terminate your personal profile or the entire application at any time, without specifying the reason. You can terminate your personal profile at any time. After termination of your personal profile, no personal data will be publically accessible through Hematool®. We can, however, not guarantee that all data will be removed from our hardware, servers, and other storage equipment.

No warranty

The use of our application is at your own risk. To the maximum extent permitted by applicable law, the application is provided without warranty of any kind, whether express or implied. Without limiting the foregoing, Hematool® does not warrant that the content is correct, reliable, or accurate; that the application will meet your needs; that the application will be available at any particular location or time or that the application is secure; that any defects or errors will be corrected or that the application is free of harmful components. Any content obtained through the use of our application is obtained at your own risk and you will be solely responsible for damage (including medical errors). We do not assume responsibility or warrant, endorse, or guarantee any content, service, or product offered through the application or offered through third parties linked to Hematool®.

Limitation of liability

In no event shall Hematool® or any of the publishers, editors, or authors have any liability whatsoever to any person for any direct or indirect loss, liability, cost, claim, expense, or damage of any kind, whether in contract or in tort, or otherwise, arising out of or related to the use or non-use of all or part of Hematool®, including but not limited to medical errors, even if Hematool® or any of the publishers, editors, or authors have been advised of the possibility of the same, unless the liability is based on unlawful intent or gross negligence of Hematool® or any of the publishers, editors, or authors.

Hematool® does not assume any responsibility or liability for any unauthorized access to or use of our servers or any and all information stored therein. We do not assume any responsibility or liability for any cessation or interruption of transmission to or from the application. Hematool® does not assume any responsibility or liability for any bugs, viruses, trojan horses, spyware, or other damaging programs that may be transmitted to or from the application.

Hematool® is operated and controlled from facilities located in Switzerland. We make no representations that the application is appropriate or available for use in other countries. Those that access or use Hematool® from other countries or jurisdictions are entirely responsible for their compliance with all applicable laws and regulations, including but not limited to import and export laws and regulations.

Indemnification

You agree to hold harmless, defend, and indemnify Hematool® and its editors, authors, employees from and against any and all claims, obligations, losses, damages, expenses, costs, or debt arising from your access or use of the application or another party’s access.

Severability Clause

To the extent that any provision of these Terms and Conditions of Use is found by any competent court or authority to be invalid, unlawful, or unenforceable in any jurisdiction, that provision shall be deemed not to be part of these Terms and Conditions, but such finding shall not affect the validity, lawfulness, or enforceability of the remainder of these Terms and Conditions of Use in that jurisdiction, nor shall it affect the validity, lawfulness, or enforceability of these Terms and Conditions of Use in any other jurisdiction.

You agree that the application is based in Basel, Switzerland and that these Terms and Conditions and the use of Hematool® are governed by Swiss law.
